Hercules Ride on Our Strength Online Sweepstakes Official Rules NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Sweepstakes runs from January 7, 2009 through December 31, 2009 (the "Sweepstakes Period").

1. Eligibility: The sweepstakes is open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older, excluding employees of The Hercules Tire & Rubber Company, its parent company, distributors, sales representatives, advertising and promotional agencies and the immediate families (spouse, children, parents, siblings and their respective spouses) or members of the households of each such employee. All federal, state and local laws and regulations apply. Void where prohibited. All entrants must have valid e-mail addresses.

2. How to Enter: To enter the sweepstakes, visit www.herculestire.com during the Sweepstakes Period and complete and submit the online entry form. Entries must be received by 11:59:59 p.m. EST on the last day of the month to be eligible for that monthly drawing. Non-winning entries will NOT carry over into subsequent drawings. Entries for the final drawing must be received by 11:59:59 p.m. (EST) on 12/31/09. Entrants will be asked to provide name, address, phone number, age, and a valid e-mail address. Entrants must complete all required information on the online entry form to be eligible. Limit one entry per person/e-mail address per calendar month. Multiple entries submitted by a single entrant during any Drawing Period are void. Automated forms of entry are not permitted. Sponsor is not responsible for lost, late, incomplete, or misdirected entries, or for any computer, hardware, software, online, telephone, or human error or technical malfunctions that may occur.

3. Prizes/Approximate Retail Value (ARV)/Odds of Winning: Twelve (12) Grand Prizes (one (1) per month): a set of 4 Hercules Tires (style and size of the winner’s choice, excluding Radial Medium Truck tires, subject to availability, up to a total retail value of $500). Maximum ARV: $500, each prize. If winner selected a set of Hercules tires with a retail value of more than $500, the winner will be responsible for the difference. If winner selects a set of Hercules tires with a retail value of less than $500, the difference in value will not be awarded. Tires will be shipped directly to the winner. Cost of mounting and balancing is not included in prize. Odds of winning depend on number of eligible entries received for each drawing. No cash substitutions or transfer of prize will be offered or permitted. Sponsor reserves the right to substitute a prize of equal or greater value in the event the requested Hercules tires are not available.

4. Random Drawings/Prize Notification: A random drawing will be conducted within five days of the end of each month during the Sweepstakes Period by an independent judging organization whose decisions are final. Potential winners will be notified by e-mail, overnight delivery and/or phone. Potential winners will be required to complete and return and Affidavit of Eligibility and Liability/Publicity Release within 10 days of notification as a condition of being awarded the prize. If prize notification is returned as undeliverable or winner fails to complete and return the Affidavit/Release within the required time, prize will be forfeited and an alternate winner will be selected.

5. General: By participating in this promotion, entrants agree to abide by and be bound by these Official Rules and the decisions of the judges, which are final in all matters relating to this promotion. A prize won by an eligible minor will be awarded to a parent or legal guardian who must sign and return all required documents. Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the sweepstakes or by any technical or human error which may occur in the processing of the entries in the sweepstakes. By accepting any prize, winner consents to use of his/her name and/or likeness for advertising and promotion purposes without additional compensation, except where prohibited. Participants waive the right to assert as a cost of winning a prize any and all costs of redemption and any liability which might arise from redeeming or seeking to redeem said prize. By accepting prize, winner agrees to release The Hercules Tire & Rubber Company, and its parent company, directors, officers, employees and agents, including without limitation its advertising and promotion agencies, from any and all liability for loss or damage incurred with respect to the awarding, receipt, possession, use or misuse of any prize. Sponsor reserves the right, in its sole discretion, to cancel or suspend the sweepstakes and award the prizes in a random drawing from among all eligible entries received prior to action taken by Sponsor, should virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the sweepstakes. If for any reason the sweepstakes program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, or software, or for failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes.

CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.
